By engaging our Services, you agree to be bound by these Terms.
1. Use of Our Website and Services
You agree to use our website and services only for lawful purposes and in accordance with these Terms.
You are responsible for ensuring that your use complies with all applicable laws and regulations.
We provide a lead generation service for UK-based heat pump installers. The service includes:
•Campaign Setup: Creation and management of advertising campaigns on platforms such as Meta (Facebook/Instagram).
•AI Booking System: Implementation and management of an AI-powered system to qualify leads and book site surveys into your calendar.
•Creative Development: Creation of ad copy and creatives for use in the campaigns.
You must not:
Attempt to gain unauthorized access to our systems or networks
Use our content or materials for commercial purposes without written permission
Upload or transmit viruses, spam, or malicious code
2. The Guarantee
When you create an account or make a purchase, you agree to provide accurate, complete, and up-to-date information.
You are responsible for maintaining the confidentiality of your account and password.
We guarantee that we will generate a minimum of 15 Booked Site Surveys within a 90-day period ("The Term").
•Definition of a Booked Site Survey: An appointment booked into the Client's calendar with a UK homeowner who has confirmed their interest in a heat pump installation and has agreed to a specific time and date for a survey.
•Failure to Meet Guarantee: If, at the end of The Term, we have failed to deliver 15 Booked Site Surveys, we will continue to provide our Services, at no additional service fee, until the guaranteed number is reached. The Client remains responsible for all advertising costs during this extension period.
We reserve the right to refuse or cancel any order at any time for reasons including suspected fraud, unauthorized use, or product/service availability.
3. Client Obligations
To ensure the success of the Services, the Client agrees to:
•Pay for Advertising Spend: The Client is solely responsible for paying all advertising costs directly to the advertising platform (e.g., Meta). This ad spend is separate from our service fee. We recommend a budget of £30-£50 per day, but the final amount is at the Client's discretion.
•Timely Communication: The Client must make all reasonable efforts to attend and follow up on the Booked Site Surveys we provide.
•Provide Access: The Client must provide necessary access to business information and calendars required for the setup and management of the Services.
•Maintain Professionalism: The Client is responsible for the quality of their sales process and service delivery.
Our guarantee covers the delivery of appointments, not the Client's ability to convert those appointments into paying customers.
4. Fees and Payment
All payments must be made in full at the time of purchase unless otherwise agreed in writing prior to the commencement of services Any alternative arrangements will be confirmed in writing before work begins.
If you fail to pay for services rendered, we reserve the right to suspend or terminate access to your account or services without further notice.
5. Term and Termination
The Term of this agreement is 90 days from the date the advertising campaigns go live.
•Termination by Client: The Client may choose to terminate this agreement at any time, but the service fee is non-refundable.
•Termination by Us: We reserve the right to terminate this agreement if the Client fails to meet their obligations (e.g., by not paying for ad spend) or engages in unprofessional conduct.
6. Intellectual Property
All content on this website—including text, graphics, logos, videos, and software—is the property of LeadGain or its licensors and is protected by copyright and trademark laws.
You may not reproduce, distribute, or modify any materials from our website without our express written consent.
Client Data: The Client retains all rights to the lead data (homeowner information) generated on their behalf.
•Our Systems: We retain all rights to our proprietary strategies, campaign structures, ad creatives, and system configurations developed to provide the Services.
7. Disclaimers
No Guarantee of Revenue: We guarantee Booked Site Surveys, not closed deals, revenue, or profit. The Client's sales process and conversion rate are outside the scope of our guarantee.
Third-Party Platforms: The Services rely on third-party platforms such as Meta, GoHighLevel, and Retell AI. We are not responsible for any service interruptions, policy changes, or performance issues related to these platforms.
Our website may contain links to external websites not operated by us. We are not responsible for the content or privacy practices of these third-party sites.
8. Limitation of Liability
You agree to indemnify and hold harmless LeadGain, its officers, employees, and partners from any claims, damages, or expenses (including legal fees) arising from your use of our website or violation of these Terms.
To the fullest extent permitted by law, LeadGain and its affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of your use or inability to use our website or services.
Our total liability for any claim shall not exceed the amount you paid to us, if any, for the services in question.
9. Confidentiality
Both parties agree to keep confidential all non-public information obtained during the course of this agreement.
10. Governing Law
This agreement shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of this agreement will be subject to the exclusive jurisdiction of the courts of England and Wales.
11. Changes to These Terms
We may update or modify these Terms from time to time. Updates will be posted on this page with the “Last updated” date. Your continued use of our website and/or service signifies acceptance of the revised Terms.
